Elfink UGC Terms and Conditions

From time to time, Elfink may reach out to social media users to seek permission to feature our favorite content on our websites, social channels, and promotional materials. You are reading this because Elfink has requested your permission to use your social media content in this way.

If you choose to allow us to use your social media content ("User Generated Content" or "UGC") by replying with the hashtag #YESElfink, you agree to these Terms of Use and Elfink's Privacy Policy.

Elfink reserves the right to modify these Terms of Use without prior notice by posting an updated version. Therefore, you should review the Terms of Use each time you grant permission or authorization to feature your User Generated Content.

By replying #YESElfink, you hereby grant Elfink a worldwide, perpetual, irrevocable, royalty-free, fully-paid right to use your User Generated Content in any manner Elfink deems appropriate. This includes, but is not limited to, use on Elfink’s websites, social media channels, promotional emails, advertisements, and any other marketing or advertising materials, in any current or future media. Elfink may use, display, reproduce, distribute, transmit, create derivative works, combine with other materials, alter, and/or edit your User Generated Content at its sole discretion, with no obligation to you.

You also grant Elfink the right to use your username, real name, image, likeness, descriptions of you, location, or other identifying information, including but not limited to your voice, in connection with any use of your User Generated Content.

You represent and warrant that (i) you are solely responsible for your User Generated Content, (ii) you own all rights to your User Generated Content or have obtained necessary permissions from any relevant parties, (iii) you are 18 years of age or older, (iv) Elfink’s use of your User Generated Content as described herein does not infringe on any third-party rights, including copyright, trademark, privacy, publicity, or any other rights, and does not violate any laws or regulations, and (v) the content is not defamatory, obscene, abusive, threatening, harassing, hateful, offensive, or otherwise unlawful, and does not link to harmful or executable files.

Elfink will select and publish submitted User Generated Content at its discretion. For clarity, Elfink is not obligated to use any submitted content and reserves the right to remove UGC from its platforms at any time, for any reason.

You hereby release, discharge, and agree to hold Elfink and any persons acting on its behalf harmless from any liability related to Elfink’s use of your User Generated Content.

If you believe any UGC used by Elfink is inappropriate, offensive, or infringes on someone’s rights (e.g., copyright or trademark infringement), you may report it by emailing us at service@elfink.com.
